Jobs offered to foreign workers should be jobs made available to American currently seeking jobs, and to American currently employed who could experience an increase in pay and or promotions by being hired to do these jobs. Overview: 2009 annual report "The OFLC administers the PERM program, where employers whit a current need may obtain certification for a permanent position that they have been unable to successfully fill with a domestic worker. With the exception of certain occupational sectors, employers must obtain an approved and valid labor certification from Office of Foreign Labor Certification (OFLC) before they can submit a permanent resident immigration petition to Department of Homeland Security (DHS). As part of the labor certification application process, employers must perform a labor market test to determine whether qualified U.S. workers are able, willing, and available in the area where the job will be performed. Employers also must demonstrate that employment of the foreign worker will not adversely affect the wages and working conditions of U.S. workers similarly employed, and they must pay the foreign worker at least the prevailing wage for the occupation. These and other program-related conditions must be met prior to the OFLC granting a permanent labor certification". 2011 annual report
